Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the Orbiio mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you must not use the App. The App is operated by Innoveramera Sverige AB, org. nr. 559214-4348 ("we", "us", or "our").

2. Eligibility

You must be at least 13 years old to use Orbiio. By using the App you confirm that you meet this requirement. The App is invite-only; access requires a valid invitation from an existing user or from us.

3. Your Account

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorised use of your account. We reserve the right to suspend or terminate accounts that violate these Terms.

4. Subscription and Payments

4.1 Paid Subscription

Uploading photos and videos to Orbiio requires an active paid subscription. The current price is SEK 39 per month. Subscriptions are billed monthly in advance through the Apple App Store or Google Play Store, depending on your device.

4.2 Free Trial

We may offer a free trial period at our discretion. At the end of the trial, your subscription will automatically renew at the applicable rate unless cancelled before the trial ends.

4.3 Cancellation

You may cancel your subscription at any time through your App Store or Google Play account settings. Cancellation takes effect at the end of the current billing period. We do not offer refunds for partial billing periods, except where required by applicable law.

4.4 Price Changes

We may change the subscription price upon reasonable notice. Continued use of the App after a price change constitutes your acceptance of the new price.

5. User Content

5.1 Ownership

You retain full ownership of all photos, videos, and other content ("Content") you upload to Orbiio. By uploading Content you grant us a limited, non-exclusive, royalty-free licence to store, process, and display your Content solely for the purpose of operating the App.

5.2 Private Sharing Only

Orbiio is a private sharing platform. Your Content is never made publicly discoverable, indexed by search engines, or shared with third parties outside the App.

5.3 Prohibited Content

You may not upload Content that:

• contains nudity, pornography, or sexually explicit material
• depicts or promotes violence, self-harm, or illegal activities
• infringes any third-party intellectual property rights
• constitutes harassment, hate speech, or discrimination
• contains malware, spam, or any harmful code

5.4 Enforcement

We reserve the right to remove any Content that violates these Terms without prior notice, and to suspend or terminate accounts responsible for repeated violations.

6. Acceptable Use

You agree not to:

• attempt to gain unauthorised access to any part of the App or its servers
• reverse engineer, decompile, or disassemble any part of the App
• use the App for any unlawful purpose or in violation of any applicable law
• impersonate another person or entity
• use automated tools (bots, scrapers) to access the App

7. Intellectual Property

All intellectual property rights in the App, including but not limited to its design, code, and branding, are owned by Innoveramera Sverige AB. Nothing in these Terms transfers any such rights to you.

8. Privacy

Your use of the App is subject to our Privacy Policy, which is incorporated into these Terms by reference. Please read the Privacy Policy carefully to understand how we collect, use, and protect your personal data.

9. Termination and Data Deletion

You may delete your account at any time through the App settings. Upon account deletion, your Content and personal data will be permanently erased from our servers within 60 days. You may also request earlier deletion by contacting us at the address below.

We may terminate or suspend your access to the App immediately, without prior notice, if you breach these Terms.

10. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components. To the fullest extent permitted by law, we disclaim all implied warranties.

11. Limitation of Liability

To the maximum extent permitted by applicable law, Innoveramera Sverige AB shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the App. Our total liability to you for any claim shall not exceed the amount you paid us in the twelve months preceding the claim.

12. Governing Law

These Terms are governed by the laws of Sweden. Any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the Swedish courts.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via the App or by email. Your continued use of the App after the effective date of updated Terms constitutes acceptance of those changes.
